Will the D2 variant rust?

Yes, potentially more than the S35VN one. You should clean, dry, and oil it more regularly if exposed to moisture. But for toughness and edge retention, many users prefer D2 despite the extra maintenance.

How often will I need to sharpen?

That depends on usage. With everyday carry and typical use (opening boxes, light utility tasks), the edge might last weeks if not months before needing touch-ups. For hard use (batoning, prying), more frequent sharpening.

Is this legal everywhere?
